Can a creditor get a loan written off due to unfair terms/ through court action? UK answers?

We Answered:

From your description and the article it seems that the loan agreements will have been regulated by the Consumer Credit Act.As you could apparently only use the loan to pay the training company it is a restricted use credit agreement.

From what I remember this means that the loan company has a joint liability with the supplier of the training. If none is provided then they are in breach of contract and you got little if any value in return for the loan.If that is right then you owe nothing further to the training firm. As the credit company has the same contractual liabilty as the trainer you should be entitled to have the loan written off.You should also give some thought to whether you can get a refund on any repayments you have already made.

If I were you I would try to get in touch with others in a similar position to yourself and make a joint approach to your MP and get a solicitor to act for the group.Good luck.
