You need to get legal advice and guidance from an immigration attorney. You should probably contact someone at the free Legal Aid in your city and State. You should not contact USCIS or DHS, in case if he is illegal and deportable. Even being mentally retarded and having AIDS, etc - he can still be deported back to his home country if he is apprehended by ICE and found deportable.

Also, if his SS card is marked "employment authorized only with INS or DHS authorization" - it could mean that he is presently illegal or out of status, provided that he failed to renew his visa/status, attend a court hearing, etc. in the past. Which is a very possible scenario based on the facts as you know them.

All lawful permanent residents have SS cards not marked with any employment limitation stamps. You can assume that if his SS card is marked, he is not a permanent resident (however, sometimes it might be not true, if for example, he just forgot to exchange an old SS card for a new one when he became a resident). Having it marked as "INS" instead of "DHS" means that he got his SSN long time ago.

As an illegal alien, he wouldn't be eligible for any State of federal benefits, I assume.

I'd suggest, as a social worker, you contact SSA and try to see if they have it in their records - what is his immigrant status?

The idea is that you work as an employee/apprentice for a licensed agency/investigator until you have the required experience to apply/obtain a license.
