What are the laws in Canada regarding teens under 18 living on their own and renting apartments?

We Answered:

yes, minors must pay taxes on their income. I beleive in manitoba 16 is the legal age for living on your own, but it would be best to check with child and family services. They could provide you with the information you need, and likely some resources to help you

I am not going to be very helpful with this but I will tell you what I know. First of all try posting on the winnipeg.livejournal.com community because people have asked this question before and the people on the community are very informative.

One issue is finding a place. Even being 18 and over, without any credit/proof of steady stable permanent income, you cannot get an apartment without a cosigner. I believe that contracts such as leases are not allowed to be created with minors. So, I'm not sure if even having a cosigner would work. Because being 16 isn't legally an adult they wouldn't be able to hold you to any contracts, so say if you trashed the place they couldn't go after you for damage costs. Look into it though because I know there are ways to go about things.

Is it possible to live with another family member like grandparents, an aunt and uncle? If you don't want to feel like a burden you can make sure you pay for room and board, etc.

You should DEFINITELY look though this site as well: http://www.gov.mb.ca/finance/cca/rtb/

I grew up in a horrible living situation myself. I'm only four years older than you, but I just basically suffered through it and moved out when I was 18.

Hopefully things work out!

Technically, a lease is a 'contract' and being a minor ( under 18 ) you cannot enter into the lease contract. If you are earning income and not living at home, then you will have to file income taxes and you will have to pay. At that point your parent can no longer claim you as a dependant. My only advice is to stick it out at home until you're 18, or take up one of the offers you've had on alternate living accomodations. If you're concerned about being a burden to them, then just pay them 'room and board'. That would help ease the 'burden'. And besides, moving out on your own because you think you can break even is not a good plan. There is always something unexpected going to happen.
